Terms of Service

What Force HRM is responsible for, what clients are responsible for, and what happens if either party walks away.

The service

Force HRM, operated by Vapor Technologies Ltd, is payroll software for Kenyan businesses that the client operates directly: monthly payroll calculation, statutory return preparation (PAYE, NSSF, SHIF, Housing Levy, and related obligations), bank payment file generation, and an employee self-service app. The platform computes exact figures from the data the client enters and generates the corresponding returns and remittance files; the client reviews and approves every payroll, and submits the resulting returns to KRA and the relevant statutory bodies.

Client responsibilities

Clients are responsible for providing accurate and timely employee data, approving each monthly payroll summary before it is submitted or paid out, submitting statutory returns to KRA and the relevant statutory bodies by their respective deadlines, and notifying Force HRM promptly of any employee starts, exits, or changes affecting payroll.

Service levels

Force HRM targets having every statutory return ready to file by the 5th of each month, ahead of the KRA deadline of the 9th, giving the client four days of runway to review and submit. Submission to KRA and the statutory bodies is performed by the client. Support requests are targeted for response within 1 business day on the Core plan and 4 business hours on the Pro plan, or as otherwise agreed in writing for Enterprise clients.

Liability for statutory calculations

Force HRM is responsible for the accuracy of the statutory figures it computes and the returns it prepares, based on the data the client has supplied and approved. Submitting those returns to KRA and the relevant statutory bodies, and doing so by the applicable deadline, is the client's responsibility. Clients review and approve each monthly summary before submission; approval confirms the underlying data is accurate to the client's knowledge.

Fees and billing

Fees are billed monthly in KES according to the plan selected at signup. There is no setup fee, and the first month of service is free. Fees adjust in line with headcount changes from the following billing cycle.

Data ownership on exit

Clients own their payroll and employee data. On cancellation, Force HRM will provide a full export of payroll history and employee records within a reasonable period, and will not retain client data beyond what is legally required for statutory record-keeping.

Cancellation

There is no lock-in contract. Either party may cancel the service, with reasonable notice to allow an orderly handover of the current payroll cycle.

Governing law

These terms are governed by the laws of the Republic of Kenya.
